The 30-day Florida ticket course election deadline

Florida's Basic Driver Improvement election keeps points off your record, cuts the state base fine 18%, and legally blocks your insurer from surcharging that ticket. Most sites get two things wrong: the lifetime cap (it is eight elections, not five, straight from the statute) and the deadlines (electing and completing are two different clocks).

Question 1

Do you have a CDL (commercial driver's license)?

  • Respond to the citation, generally within 30 days: that is Florida's general infraction response deadline, and your election rides on it. § 318.14(4)(a)single source · verify
  • Complete the course, 60 to 90 days from the citation date: then hand the certificate to the clerk yourself. FLHSMV FAQsingle source · verify
  • No points. Florida suspends at 12 points/12 months, 18/18, 24/36. Common tickets run 3 to 6 points. § 322.27(3)
  • Insurance protection. Florida bars insurers from adding premium over a single noncriminal infraction at 15 or less over, with or without the course. Carve-outs: a second infraction inside 18 months (third in 36) and speeding more than 15 over. The course election still matters because it keeps the points themselves off. § 626.9541(1)(o)4
  • 18% off the state base fine. The state penalty only. County court costs stack on top, so the total is county-dependent. § 318.14(9)
  • Elect and then fail to finish? You are adjudicated guilty, you owe back the 18% discount plus up to $18 processing, points hit, and the failed try still burns one of your eight lifetime elections. FLHSMV FAQ
  • Do not confuse BDI with ADI. ADI is the mandatory 12-hour course after a point-suspension; vendors love blurring them. FLHSMV handbook
  • The exclusion list is written in statute numbers, and it is picky: state speed zones are excluded entirely, municipal zones only at 30+ over, and the base statutory limit section is excluded at any speed. When in doubt, ask the clerk which statute your citation charges. § 318.14(9)

Everything runs through the clerk of court in the county where you were cited: paying, electing BDI, and filing the certificate. Find your clerk through the official statewide association, and find counsel through the Bar, not a directory ad.
